Terms of Service

1. Agreement and business authority

These Terms are an agreement between Bakaro Art LLC (“Bakaro Art,” “we,” or “us”) and the person or organization using Stratafold. If you use Stratafold for an organization, you confirm that you can bind it to these Terms. You must be at least 18 years old.

2. Accounts and customer responsibilities

You are responsible for accurate account information, authorized users, securing credentials and API keys, and activity under your account. You control your content, schemas, websites, forms, recipients and AI instructions. Notify us promptly at stratafold@bakaroart.com if access may be compromised.

3. Trial, subscriptions and renewal

One 14-day trial is available per person. It has Free limits, does not include managed AI credit, and does not charge automatically unless you separately choose a paid plan and provide a payment method. Paid monthly and annual plans renew automatically at the displayed price and frequency, plus applicable tax, until canceled. If you choose a paid plan before a trial ends, Checkout shows when the first charge will occur.

You may cancel online at any time from Business settings → Manage billing. Cancellation stops future renewals and normally takes effect at the end of the paid period. Except where law requires otherwise, charges already paid are non-refundable and partial periods are not prorated. We will clearly disclose a price change before it applies to a renewal.

4. Managed AI and service credits

Paid plans may include managed AI service credit. One credit represents $0.01 of Stratafold managed AI service and is charged using the published model-specific input/output token rate. Included credit expires at the end of its billing period. Purchased credit expires one year after the date of purchase, whether or not a paid plan is active during that year, and requires an active paid plan to use. Credits are non-transferable, have no cash value, are not redeemable, and are non-refundable except where required by law. We reserve a job’s maximum charge before it runs and return unused credit afterward.

If you bring your own provider key (“BYOK”), that provider bills you directly under its terms and Stratafold credit is not consumed. AI output may be inaccurate or unsuitable. You are responsible for human review before publishing or relying on it.

5. Customer content and permission to process it

You retain your rights in content you submit. You give us the limited permission needed to host, copy, transform, scan, transmit and otherwise process it to provide, secure and support Stratafold. You confirm that you have the rights and notices needed to process the content and personal information you place in the service, including form submissions and mailing lists.

6. Acceptable use

Do not use Stratafold to break the law; infringe rights; distribute malware; evade security or usage controls; probe systems without permission; send unlawful or unsolicited communications; generate abusive, deceptive or harmful material; or impose unreasonable load. Do not resell access to Stratafold or its managed provider credentials unless we agree in writing. We may suspend access needed to stop abuse, protect people or systems, or comply with law.

7. Service availability and account status

We work to keep Stratafold available but do not promise uninterrupted or error-free operation. After a trial expires, or after any stated payment grace period, the dashboard becomes read-only and delivery APIs, forms, publishing, automation and AI may pause. You can restore them by activating a paid plan. We may change or discontinue features with reasonable notice when practical.

8. Third-party services

Stratafold interoperates with services such as Stripe, hosting and storage vendors, mail providers and AI providers. Their terms govern your direct use of them. We are not responsible for third-party services outside our control.

9. Confidentiality and data protection

Each party will protect the other’s non-public confidential information and use it only for this agreement. Our processing practices are described in the Privacy Policy. Contact us if your organization needs a data processing agreement before placing regulated personal data in Stratafold.

10. Disclaimers and liability

To the extent permitted by law, Stratafold is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose or non-infringement. Neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue, data or goodwill. Our total liability arising from Stratafold will not exceed the amount you paid us for it in the 12 months before the event giving rise to the claim. These limits do not apply where they are prohibited by law.

11. Termination and changes

You may stop using Stratafold and delete a business from its settings. We may terminate for material breach after reasonable notice when cure is possible, or immediately for serious abuse or legal necessity. Provisions that by nature should survive termination do. We may update these Terms; material changes will be announced before they take effect, and continued use afterward means acceptance.
